TERMS & CONDITIONS
RC Kits (RCK) is a trade name of JSE Repair LLC.
SECTION 1 - ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order
confirmation does not signify our acceptance of your order, nor does it
constitute confirmation of our offer to sell. RCK reserves the right at any
time after receipt of your order to accept or decline your order for any reason
or to supply less than the quantity you ordered of any item.
SECTION 2 - CREDIT CARDS
Through our payment processors (Shift4 and PayPal), we
accept most credit cards. There is no surcharge for using your credit card to
make purchases. Please be sure to provide your exact billing address and
telephone number (i.e. the address and phone number your credit card bank has
on file for you). Incorrect information will cause a delay in processing your
order. Your credit card will be billed upon our receipt of your order.
SECTION 3 - MONEY ORDERS, CASHIER'S CHECKS, COMPANY
CHECKS & PERSONAL CHECKS
We accept money orders, cashier’s checks, personal checks,
and company checks in US dollars only. Orders are processed upon receipt of a
money order or cashier’s check. For personal and company checks, please allow
up to 10 banking days after receipt for clearance of funds before the order is
processed. We cannot guarantee the availability of a product by the time funds
clear or payment is received. We will charge a $25 fee on all returned checks.
All checks and money orders must be made payable to “JSE Repair LLC”.
SECTION 4 - ORDER SHIPPING POLICY
Every order is individually cut and packaged. Most orders
will ship within three business days, provided the raw material is in stock.
From time to time, RCK will close for vacation or other personal reasons. We
attempt to provide at least a week's notice prior to any closure, but we cannot
guarantee that prior notice will always be provided.
Orders are not processed or shipped on Saturday, Sunday or US holidays. We
cannot guarantee when an order will arrive. Consider any shipping or transit
time offered to you by RCK or other parties only as an estimate. We encourage
you to order in a timely fashion to avoid delays caused by shipping or product
availability.
International (non-USA) orders can be insured up to a
maximum of US $200. We are not responsible for loss or damage incurred in
shipping, in excess of the insured amount.

SECTION 5 - OUT OF STOCK MATERIALS
There may be times when the materials need to produce the
product you have ordered are out-of-stock which will delay fulfilling your
order. We will keep you informed of any products that you have ordered that are
out-of-stock and unavailable for timely shipment. You may cancel your order at
any time prior to shipping.
SECTION 6 - MULTIPLE PRODUCT ORDERS
For a multiple product order, we will make every attempt to
ship all products contained in the order at the same time. Products that are
unavailable at the time of shipping will be shipped as they become available,
unless you inform us otherwise. You will only be charged for shipping at the
rate quoted to you on your purchase receipt. The entirety of this shipping
charge may be applied to the first product(s) shipped on a multiple shipment
order.
SECTION 7 – TAXES
Our store shall automatically charge and withhold the
applicable sales tax for orders to be delivered to addresses within the state
of Michigan. For orders shipped to other states and countries, you are solely
responsible for all sales taxes or other taxes and duties.
SECTION 8 - TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price due
to typographical error or error in pricing information received from our
suppliers, RCK shall have the right to refuse or cancel any orders placed for
product listed at the incorrect price. RCK shall have the right to refuse or
cancel any such orders whether or not the order has been confirmed and your
credit card charged. If your credit card has already been charged for the
purchase and your order is canceled, RCK shall immediately issue a refund
credit to your credit card account.
SECTION 9 - LINKS
This site may contain links to other sites on the Internet
that are owned and operated by third parties. You acknowledge that RCK is not
responsible for the operation of or content located on or through any such
site.

Unless otherwise specified, all materials appearing on this
site, including the text, site design, logos, graphics, icons, and images, as
well as the selection, assembly and arrangement thereof, are the sole property

content of this site only for the purpose of shopping on this site or placing
an order on this site and for no other purpose. No materials from this site may
be copied, reproduced, modified, republished, uploaded, posted, transmitted, or

the materials appearing on this site may violate copyright, trademark and other

SECTION 11 – DISCLAIMER
RC Kits sells "short kits" only. Short kits
contain only the specially-shaped balsa, basswood and plywood parts. Some of
our kits may contain additional parts, as described on the catalog pages. For a
more complete description of short kits, please refer to our FAQ section.
RC Kits accepts no responsibility for crash damage and/or loss of kits,
engines, accessories, etc. incurred during operation or building of a RC Kits
short kit.
We do not guarantee product compatibility for product recommendations. We
provide information and suggestions to the best of our abilities based on the
information available to us at the time.
All of the products sold by RC Kits are intended for retail consumption by our
customers and are not intended for resale. We reserve the right not to sell to
resellers. Any consequences arising out of the resale of merchandise purchased
from RC Kits is the responsibility of the reseller, not RC Kits. We may deny
sales to customers who commercially resell our products.
We are not responsible for errors or flaws in CAD files that you furnish to us
for custom work.
SECTION 12 – WAIVER AND RELEASE FROM LIABILITY
You HEREBY ACKNOWLEDGE that you understand that flying model
aircraft is an extremely dangerous activity and may result in injury and or
death, even when practiced by a competent pilot using proper equipment. You
further acknowledge that you am aware of and understand the types of hazards
and dangers, both real and hidden, involved in flying model aircraft and accept
any and all of the risks of possible injury or death. You understand that the
model aircraft products manufactured and distributed by RC Kits have not been
designed, manufactured or tested to meet any federal or state government
air-worthiness standards or regulations. You understand that flying model
aircraft is an extremely demanding activity requiring exceptional levels of
attention, judgment, maturity, and self- discipline, requiring you to make a
conscious and continual commitment to your own safety and the safety of those
around you. In particular, you understand that gusty winds or turbulence may
interfere with even an expert pilot's ability to safely control flying mode
aircraft and thereby cause it to crash.
You HEREBY RELEASE, AGREE TO HOLD HARMLESS AND INDEMNIFY JSE Repair LLC and
its owners, agents and employees, and individual kit designers, for any and all
liability for any loss, damage, injury or death to yourself or to any other
person or property resulting from the use of these products and you further
agree to waive, and not make any claim or file any suit based upon negligence,
breach of warranty, contract or other legal theory. This release and agreement
to hold harmless and to indemnify shall be binding upon you, your legal
representatives, heirs, legatees and assigns as well as upon all who may be
dependent upon or entitled to your services, consortium or support. Should you
breach this agreement by filing any such suit or making any such claim, you
will pay all attorney's fees and costs of the released parties. You agree that
this release shall be governed by and construed in accordance with the laws of
the State of Michigan. All disputes and matters whatsoever arising under, in
connection with or incident to this agreement shall be litigated, if at all, in
and before a court located in the State of Michigan, USA, to the exclusion of
the courts of any other state or country. If any part, article, even paragraph,
sentence or clause of this agreement is not enforceable, the effected
provisions shall be curtailed and limited only to the extent necessary to bring
it within the requirements of the law and the remainder of the agreement shall
continue in full force and effect.
You VOLUNTARILY ASSUME all risks, known and unknown, of any injuries, personal
or financial or of wrongful death, however caused, if caused in part or in
whole by the action, inaction or negligence of any of the released parties
named above to the fullest extent of the law. You represent that you are at
least 18 years of age and you acknowledge that you have read this agreement,
fully understand the potential dangers of engaging in flying model aircraft products
from RC Kits and am fully aware of the legal consequences of accepting this
agreement. You understand and agree that this document is legally binding and
will preclude you from recovering monetary damage from the above listed
entities and or individuals, whether specifically named or not, for personal
injury, bodily injury, property damage, wrongful death or any other personal or
financial injury sustained by you in connection with the use of any model
aircraft product from RC Kits.
SECTION 13 – KIT WARRANTY
RC KITS supplies model kits cut and molded to the designer’s
specifications.
We guarantee all model kits to be free from defects in
material we provide and in our workmanship. We DO NOT guarantee the designer’s
work. We will replace any wood, plastic or paper component from our kit that is
shown to be defective according to the specifications provided by the designer.
Claims for defective parts must be made within 30 days of purchase. If you
believe that a part is incorrectly designed or specified, you must contact the
original designer for resolution.
We cut parts directly from cut files furnished to us by the
original designer. If a parts fit issue is encountered, please contact the
original designer for assistance.
RC KITS sells "short kits" only. Please refer to
our FAQ page for our definition of the term.
We try to provide web links to a build thread or other
information about each kit we produce. Before you purchase a kit, you should
review the information at those sites, and contact the kit designer if you have
questions or need more information about a specific kit.

SECTION 14 - OTHER CONDITIONS
These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether RCK signs them or not. We reserve the right to make changes to this site and these Conditions at any time.
